On 30 August, the people of Guinea-Bissau will be called upon to participate in a popular referendum to decide whether to approve a new Constitution adopted by the National Transitional Council in January 2026 and promulgated in February 2026. However, there has been no official confirmation that it was published in the Official Gazette. Nevertheless, reports have been circulating within Guinean society that the new Constitution has already been published in the Official Gazette. This was later reinforced by the release of an audio recording confirming that the Constitution had been promulgated and published in the Official Gazette.
In the recording, the former Minister of Foreign Affairs, former Minister of Justice, and current Minister of Environment, Biodiversity and Climate Action, Dr Carlos Pinto Pereira, also stated that the referendum is an attempt, after the fact, to confer legitimacy on the new Constitution.
Therefore, the new Constitution has not gone through a transparent process, including with regard to its publication in the Official Gazette, which is necessary for it to acquire full legal force. It is also an exclusionary Constitution because it did not ensure broad participation by Guineans, effectively excluding Guineans living in the diaspora from participating in the decision on the country’s fundamental law, which establishes the basic principles governing the organisation of the state.

No dia 30 de agosto o povo da Guiné-Bissau será submetido a Referendo Popular para decidir se uma nova Constituição aprovada pelo Conselho Nacional de Transição em janeiro de 2026 e promulgada em fevereiro de 2026, embora não haja confirmação oficial de que foi publicada no Boletim Oficial, mas nos bastidores da sociedade guineense, paira no ar as informações de que a nova Constituição já foi publicada no Boletim Oficial, até que o áudio tornado público e que confirma que a Constituição, foi publicada, Promulgada e Publicada no Boletim Oficial, nesse áudio do Ex-ministro do Negócio Estrangeiro, Ex Ministro da Justiça e atual Ministro de Ambiente, Biodiversidade e Ação Climática Dr. Carlos Pinto Pereira, afirmou ainda que o Referendo é uma tentativa a posteriori de dar legitimidade à nova Constituição. Portanto, essa nova Constituição, não atingiu um processo transparente até a publicação no Boletim Oficial para que possa ter força jurídica plena, também é uma Constituição excludente, porque não garantiu a participação ampla dos guineenses, excluindo os guineenses que vivem na diáspora decidir uma lei fundamental do país que estabelece os princípios básicos da organização do Estado.
