Event Summary
In December 2025 and January 2026, there have been some ongoing consultations on Bill No. 25129 which amends Law No. 7786 (Law on Narcotics, Psychotropic Substances, Unauthorised Drugs, Related Activities, Money Laundering and Terrorist Financing). The aim of the bill is to strengthen compliance with the Recommendations of the Financial Action Task Force (FATF), particularly Recommendation 8, regarding the protection of non-profit organisations (NPOs) from the risks of terrorist financing. The bill was introduced on 5 August 2025 and is currently before the Special Permanent Commission on Security and Drug Trafficking. To date, there is no specific date set for its discussion in the Legislative Plenary.
A public consultation process on the bill has been opened, leading to public hearings. Unlike restrictive approaches applied in other contexts, this initiative seeks to introduce a risk-based, proportionate and non-discriminatory framework, aligned with the latest international standards. The bill explicitly recognises that NPOs should not be treated as a homogeneous or inherently risky sector, and that supervisory measures should be differentiated according to the type of organisation, its size, its activities and its actual exposure to risk.
It also seeks to avoid excessive administrative burdens that could hinder the legitimate operation of civil society, while strengthening transparency and due diligence mechanisms. In the Costa Rican context, this reform represents a positive step toward harmonising financial security and civil liberties, contributing to a clearer, more predictable regulatory environment that respects the fundamental role that NPOs play in the country’s social, environmental and democratic development.
Proyecto de Ley 25.129 busca evitar abuso para ONGs por regulaciones contra el financiamiento del terrorismoEl Proyecto de Ley N.º 25129 propone una reforma a la Ley N.º 7786 (Ley sobre estupefacientes, sustancias psicotrópicas, drogas de uso no autorizado, actividades conexas, legitimación de capitales y financiamiento al terrorismo) con el objetivo de fortalecer el cumplimiento de las Recomendaciones del Grupo de Acción Financiera Internacional (GAFI), en particular la Recomendación 8, relativa a la protección de las organizaciones sin fines de lucro (OSFL) frente a los riesgos de financiamiento del terrorismo.El proyecto de ley fue presentado el 5 de agosto de 2025 y actualmente se encuentra en la Comisión Permanente Especial de Seguridad y Narcotráfico. Hasta la fecha, no hay una fecha específica prevista para su discusión en el Plenario Legislativo. Se abrió un proceso de consultas públicas sobre el proyecto de ley, lo que conduce a audiencias.A diferencia de enfoques restrictivos aplicados en otros contextos, esta iniciativa busca introducir un marco basado en el riesgo, proporcional y no discriminatorio, alineado con los estándares internacionales más recientes. El proyecto reconoce explícitamente que las OSFL no deben ser tratadas como un sector homogéneo ni inherentemente riesgoso, y que las medidas de supervisión deben diferenciarse según el tipo de organización, su tamaño, sus actividades y su exposición real a riesgos.Asimismo, procura evitar cargas administrativas excesivas que puedan obstaculizar la operación legítima de la sociedad civil, al tiempo que fortalece los mecanismos de transparencia y debida diligencia.En el contexto costarricense, esta reforma representa una señal positiva hacia la armonización entre la seguridad financiera y las libertades cívicas, contribuyendo a un entorno normativo más claro, predecible y respetuoso del rol fundamental que desempeñan las OSFL en el desarrollo social, ambiental y democrático del país.
