Restrictions on Social Organizations in the New Organic Law Regulations

Event Summary

On 28 October 2025, the Office of the Presidency issued the General Regulations to the Organic Law on Social Transparency. The regulation, composed of 74 articles, includes provisions that prohibit organizations from intervening, “directly or indirectly,” in activities aimed at “obstructing or interfering with legally authorized mining projects.” Organizations that fail to comply may have their legal status suspended for up to four years (Article 4, sections 6 and 7 of the Regulation).

The regulation also prohibits the use of national or international funds to “promote, finance, or carry out actions intended to halt mining activities or mining rights established under the Mining Law” (General Provision Six). Moreover, it requires that organizations implementing projects related to the monitoring or auditing of mining activities limit their work “exclusively to those objectives” (General Provision Seven).

These provisions constitute a violation of the right to freedom of assembly and association, while also putting at risk environmental and community organisations that raise legitimate concerns about the impacts of mining on their territories.

So far, there has been no official statement from social organizations or collectives, although the issue has begun to receive coverage in media outlets close to these sectors.
