The respect and protection of fundamental freedoms remains largely unchanged since the submission of the previous Enabling Environment Snapshot. There are some troubling developments looming, however. Non-profit organisations still risk losing their freedoms to operate under the draft Act on Associations and Foundations, which is currently being reviewed by the Ministry of Interior. Additionally in September 2025, the Thai Appeals Court sentenced five pro-democracy activists under Section 110 of the Criminal Code for their participation in a 14 October 2020 demonstration at the Democracy Monument, during which they allegedly obstructed a royal motorcade. The court overturned their earlier acquittal, sentencing one activist to 21 years and four months in prison and the remaining four to 16 years each. While several amnesty proposals were debated in Parliament, including one advanced by the coalition of civil society organisations that would have granted amnesty to Section 112 and 110 cases, only three bills excluding Sections 112 and 110 were accepted in principle, and are scheduled for the second reading in Parliament in late October 2025.
