Event Summary
On 11 September 2025, civil society organisations (CSOs) in Zambia issued a joint statement warning against the possible reintroduction of the Constitution of Zambia (Amendment) Bill No. 7 of 2025. This concern arises despite the Bill having been deferred by President Hakainde Hichilema following a meeting with CSOs on 24 June 2025, during which he committed to broad consultations. Subsequently, on 27 June 2025, the Constitutional Court declared the Bill unconstitutional due to insufficient public consultation. Despite this, on 5 September 2025, the Speaker of the National Assembly, Ms. Nelly Mutti, said that she had noted a general plea from Chiefs in Muchinga Province for government to go ahead with the constitutional review process. This statement has reignited fears among CSOs that the Bill may be reintroduced in Parliament, potentially in defiance of the Court’s ruling. In response, CSOs have publicly expressed concern that such a move would undermine democratic principles and the rule of law. The situation poses serious implications for the enabling environment for civil society in Zambia, as it reflects a potential disregard for judicial authority and inclusive governance, threatening the space for meaningful civic engagement and participation in Zambia’s democratic processes.
Suggested actions include sustained public mobilization, legal preparedness to challenge any unconstitutional reintroduction, direct advocacy with Parliament and the Executive, and targeted international engagement to highlight the risks of undermining judicial authority.
