Event Summary
On 16 December 2025, Paraguayan civil society organizations filed an Action of Unconstitutionality against Law No. 7363 before the Supreme Court. The so-called “Anti-NGO Law” or “Garrote Law” was enacted in November 2024 and eventually put into force on 23 October 2025 through Decree No. 4806. The action was filed by the Human Rights Coordinator of Paraguay (CODEHUPY), representing 33 CSOs working across the territory and with communities. It considers that the regulation affects freedom of association, freedom of expression, political participation and the principle of legality. It violates fundamental rights that are guaranteed in the National Constitution as well as international obligations for the protection of civic space. Additionally, it undermines solidarity initiatives, educational, cultural, agricultural and social support projects throughout the country.
The appeal questions the excessive control of the State over the formation, operation and financing of civil society organizations, established by the new legal instrument, which introduces an excess of political control and enables a regime of permanent suspicion, together with the application of disproportionate sanctions, deemed incompatible with a democratic, rights-based system.
The CSOs have requested a review of the constitutionality of the law and the immediate suspension of its effects, until the merits of the matter are decided upon. While waiting for the Constitutional Chamber of the Court to rule on the admission of the Action, the CSOs have clarified that their objective is to defend democracy, the rights of civil society organizations as well as of all citizens. The Action of Unconstitutionality highlights the adverse environment for CSOs and the decision of the Supreme Court will determine whether this disabling legal framework will be maintained or whether the state will move towards more robust protection of fundamental freedoms.
Organizaciones sociales presentaron acción de inconstitucionalidad contra Ley “Anti ONG”En fecha 16 de diciembre, organizaciones de la sociedad civil paraguaya presentaron ante la Corte Suprema de Justicia una Acción de Inconstitucionalidad (AI) contra la Ley N° 7363, denominada “Ley Anti ONG” o “Ley Garrote”, promulgada en noviembre 2024 y el Decreto N° 4806 que la reglamentó y la puso en vigencia el 23 de octubre último. La acción presentada en la Sala Constitucional por 33 OSC que trabajan en territorio y con comunidades, con representación a cargo de la Coordinadora de Derechos Humanos del Paraguay (CODEHUPY), considera que la normativa afecta la libertad de asociación, libertad de expresión, de participación política y el principio de legalidad. Vulnera derechos fundamentales que se encuentran garantizados en la Constitución Nacional como obligaciones internacionales para la protección del espacio cívico. Y quebranta iniciativas solidarias, proyectos educativos, culturales, agrícolas y de acompañamiento social en todo el país.Con el recurso planteado se cuestiona el control excesivo del Estado sobre la conformación, el funcionamiento y el financiamiento de las organizaciones sociales, establecido por el nuevo instrumento legal; se indica que éste introduce un exceso de control político y habilita un régimen de sospecha permanente, junto con la aplicación de sanciones desproporcionadas que no son compatibles con un sistema democrático basado en derechos.Las OSC han solicitado la revisión de la constitucionalidad de la ley y la suspensión inmediata de sus efectos, hasta tanto se defina el fondo de la cuestión. Mientras se aguarda que la Sala Constitucional de la Corte se expida sobre la admisión de la AI, las OSC manifiestan que es objeto de la misma la defensa de la democracia, los derechos de las organizaciones y de los derechos de la ciudadanía toda. La presentación de la AI informa sobre un ambiente adverso para las OSC y su resolución dará cuenta de la permanencia o no de tales condiciones directamente vinculadas al marco legal y el ejercicio de derechos fundamentales.
