Bill proposes to criminalize the dissemination of “gender ideology” materials

Español English Español English English Español

On 21 October 2026, “pro-life and pro-family” groups presented to Congress a draft bill that, under the premise “no to gender ideology,” proposes up to twenty years in prison for those who produce or disseminate materials that, according to their arguments, may alter children’s perception of sexuality or their biological identity. The initiative, which had been announced in September by an evangelical pastor, proposes the modification of Article 135 of the Penal Code, relating to sexual abuse of children, and includes, in addition to the dissemination of materials, the penalization of “acts that could interfere, alter or damage the child’s natural perception of sexuality, the exercise of it or its biological identity”. Opposition leaders indicated that, in addition to promoting censorship and persecution, this draft bill will benefit child abusers rather than promote the protection of children. This is because the proposal is based on Law No. 6002/2017 that had modified said Art. 135 of the Criminal Code years ago, but which was already repealed in 2024 with Law No. 7394, currently in force, which increased the penalties for sexual abuse, expanded the aggravating circumstances, and added new punishable conducts. The new draft presented in October adds high prison sentences for the dissemination of materials or behaviors based on “gender ideology” and, contradictorily, reduces the current penalty for sexual abuse.

The draft bill was received by congressmen from the ruling party, who pointed out that it represented a common clamor. Days earlier, the Association of Evangelical Churches of Paraguay (ASIEP) had invited people to join the mobilization ‘in defense of life and the family’ planned for the delivery of the draft bill. The Archdiocese of Asunción distanced itself from the draft bill and reaffirmed its commitment to the defense of life and human dignity, as well as the obligation to respect all people regardless of their sexual orientation.

Different civil society organizations have also expressed rejection of this initiative. They maintain that, if considered and approved, it will have consequences on freedom of expression, thought, press and teaching. They also express concern that the existence of trans people and the LGBTIQ+ community is criminalized and that applying a “gender perspective” is deliberately equated with promoting a “gender ideology”. Instead of the draft bill, the organizations demand the strengthening of the Ministry of Children and Adolescents (MINNA) and the Municipal Councils for the Rights of the Child and Adolescent (CODENI) as well as the guarantee of comprehensive sexuality education based on scientific evidence, which includes taking out of circulation the materials of Education in Affectivity and Sexuality (EASES). These materials are currently the subject of complaints about their sexist approaches which include the “subordination of women” and mark a serious setback in the progress that had been achieved. The materials have been applied experimentally by the Ministry of Education without considering the opinions of the Ministries of Children and Adolescents and Health that disapproved them.

The draft bill presented to Congress thus adds to the ongoing rollback of gender equality and gender-related rights, negatively affecting policies that are necessary to ensure non-discrimination and ignoring the participation of civil society organizations and human rights defenders.
