Adoption of a draft ordinance strengthening the revocation of citizenship: a worrying development for civil liberties and civic space

At a meeting of the Council of Ministers on 17 July 2026, chaired by General Assimi Goïta, the Government of Mali adopted a draft ordinance amending Act No. 2011-087 of 30 December 2011 on the Personal and Family Code, which governs, in particular, the loss and forfeiture of Malian nationality. Presented by the Minister for Justice and Human Rights, Keeper of the Seals, Mamoudou Kassogué, as a response to the shortcomings of the current system in the face of the ‘hostile actions’ of certain nationals, the reform extends revocation to Malians by birth, whereas this mechanism had previously been reserved, in almost all cases, for naturalised persons.

The new grounds include formal allegiance to another state, the use of former public office to harm Mali’s interests, holding a position of responsibility within a civil society organisation, a cooperative or a public-interest association, coupled with cooperation with entities classified as ‘hostile’ and pursuing secessionist or terrorist aims; exile combined with membership of a terrorist or separatist organisation; and acts of terrorism, the financing of terrorism or the glorification of terrorism. Deprivation of nationality may only be pronounced if it would render the person stateless. The text has so far only been adopted by the Government. Its promulgation by the President for it to come into force and its ratification by the legislature to ensure its long-term validity are still pending.

Adoption d’un projet d’arrêté renforçant la déchéance de nationalité : une évolution préoccupante pour les libertés individuelles et l’espace civique

Lors d’une séance du Conseil des ministres tenue le 17 juillet 2026, présidée par le général Assimi Goïta, le gouvernement du Mali a adopté un projet d’ordonnance modifiant la loi n° 2011-087 du 30 décembre 2011 portant Code des personnes et de la famille, qui régit notamment la perte et la déchéance de la nationalité malienne. Présentée par le ministre de la Justice et des Droits de l’Homme, garde des Sceaux, Mamoudou Kassogué, en réponse aux lacunes du système actuel face aux « agissements hostiles » de certains ressortissants, cette réforme étend la déchéance aux Maliens de naissance, alors que ce mécanisme était auparavant réservé, dans la quasi-totalité des cas, aux personnes naturalisées.

Les nouveaux motifs comprennent l’allégeance formelle à un autre État, l’utilisation d’une ancienne fonction publique pour nuire aux intérêts du Mali, l’exercice d’un poste à responsabilité au sein d’une organisation de la société civile, d’une coopérative ou d’une association d’intérêt public, associé à une coopération avec des entités qualifiées d’« hostiles » et poursuivant des objectifs sécessionnistes ou terroristes ; l’exil associé à l’appartenance à une organisation terroriste ou séparatiste ; ainsi que les actes de terrorisme, le financement du terrorisme ou la glorification du terrorisme. La déchéance de nationalité ne peut être prononcée que si elle rend la personne apatride. À ce jour, le texte n’a été adopté que par le gouvernement. Sa promulgation par le président, nécessaire à son entrée en vigueur, ainsi que sa ratification par le pouvoir législatif, indispensable pour garantir sa validité à long terme, sont encore en suspens.
