Temporary dismissal of the criminal complaint for slander and defamation against journalist Sabrina Bacal and media outlets

Español English Español English English Español

On 2 October 2026, the Metropolitan Public Prosecutor’s Office (Section for Offences against Liberty, Honour, the Administration of Justice and the Internal Structure of the State) ordered the provisional dismissal of the criminal complaint for slander and defamation brought by the businessmen Roberto and Ramón Carretero Napolitano against the journalist Sabrina Bacal, as well as against the news and investigative websites Armando.info and Praxis, amongst other media outlets.

The Prosecutor’s decision was based on the absence of sufficient evidence to prove that offences against honour had been committed, emphasising that the publications that were the subject of the complaint dealt with matters of significant public interest, public procurement and the economic activities of public figures. The ruling also incorporated an expert report by the former Special Rapporteur on Freedom of Expression at the Inter-American Commission on Human Rights (IACHR), Catalina Botero, which concluded that collaborative transnational reporting and investigations are protected by the constitutional and international right to inform and be informed.

The Prosecutor’s decision also referred to the ruling by the Inter-American Court of Human Rights (IACHR) in the case of Tristán Donoso v. Panama: “the protection of honour and freedom of expression must be subject to a specific balancing test and that, in certain circumstances, the imposition of a criminal sanction may constitute an unnecessary or disproportionate restriction on freedom of expression.”
