Constitutional Court removes Sibanda Constitutional Amendment Act No 3 challenge from 30 September roll

The Constitutional Court Registrar has removed Prince Dubeko Sibanda v Parliament of Zimbabwe and Others, CCZ 271/26 from the court roll for 30 September 2026. A notice dated 23 September advised the parties that they would be informed of a new hearing date in due course, but gave no reason for the removal. The case challenges Constitutional Amendment Act No 3 provisions that extend presidential and parliamentary terms and purport to apply the longer terms to current office-holders despite section 328(7) of the Constitution. This is a procedural timetable change, not a judgment on the constitutionality of Amendment No 3. The Act remains operative, and the related war veterans’ direct-access application also remains awaiting judgment. This development postpones judicial consideration of whether the term-extension provisions may lawfully benefit incumbents and leaves affected advocacy and monitoring teams without a new hearing date.
