Constitutional Court reserves CAB3 direct access judgment as separate MDC CAB3 hearing is postponed

On 22 September 2026, Zimbabwe’s Constitutional Court heard case CCZ 273/26, an application by six liberation war veterans seeking permission to challenge the Constitution Amendment Bill No. 3 (CAB3) directly before the Court. The applicants contest the replacement of direct presidential elections with election by Parliament and argue that changing how citizens exercise the right to vote required a referendum. The State opposed the granting of direct access and argued that the applicants should begin in the High Court. The Court reserved judgment on this procedural question and the matter has not yet decided the constitutional merits. A different MDC challenge, previously scheduled for 23 September, was postponed with no replacement date publicised. These developments advance one CAB3 case while delaying another, leaving the Act operative and its validity unresolved.
