On 28 July 2026, the Bir Mourad Raïs Administrative Court in Algiers ordered the dissolution of the National Autonomous Council of Teaching Staff in the Tertiary Education Sector (CNAPESTE), an independent trade union recognised since 2007, and ordered the appointment of a liquidator. The proceedings had been initiated on 9 March 2026 by the Ministry of Labour, with the support of the Ministry of National Education, on the basis of Law No. 23-02 on the exercise of trade union rights, in particular on grounds relating to the compliance of the statutes and representativeness.
The trade union and its defence group maintain that they have fulfilled the necessary formalities and regard the proceedings as an attempt to neutralise independent trade union action. As the judgement is subject to provisional enforcement, the dissolution takes effect immediately, even if an appeal is lodged. This decision seriously undermines freedom of association, pluralism in the representation of workers and the ability of independent organisations to participate in social dialogue. Amnesty International has called for the immediate annulment of the judgement, whilst several political and civil society actors have denounced this as a major violation of trade union freedoms.
Dissolution judiciaire du CNAPESTE et atteinte au pluralisme syndical en Algérie
Le 28 juillet 2026, le tribunal administratif de Bir Mourad Raïs, à Alger, a ordonné la dissolution du Conseil national autonome du personnel enseignant du secteur de l’enseignement supérieur (CNAPESTE), un syndicat indépendant reconnu depuis 2007, et a ordonné la nomination d’un liquidateur. La procédure avait été engagée le 9 mars 2026 par le ministère du Travail, avec le soutien du ministère de l’Éducation nationale, sur la base de la loi n° 23-02 relative à l’exercice des droits syndicaux, notamment pour des motifs liés à la conformité des statuts et à la représentativité.
Le syndicat et son groupe de défense affirment avoir rempli toutes les formalités requises et considèrent cette procédure comme une tentative visant à neutraliser l’action syndicale indépendante. Le jugement faisant l’objet d’une exécution provisoire, la dissolution prend effet immédiatement, même en cas d’appel. Cette décision porte gravement atteinte à la liberté d’association, au pluralisme dans la représentation des travailleurs et à la capacité des organisations indépendantes à participer au dialogue social. Amnesty International a appelé à l’annulation immédiate du jugement, tandis que plusieurs acteurs politiques et de la société civile ont dénoncé cette décision comme une violation majeure des libertés syndicales.
